CLINIC TELECONSULTATION TERMS OF USE

This is an agreement between Twareat Health (“twareat.com") and you, a user of the Clinic Tele Consultation Service. By using the service, you acknowledge and agreed to these terms if use. If you chose to not agree with any of these terms, you may not user the service.

Information provided by you through the service will be transmitted via the internet medium that Twareat Health has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party who receives the information. In addition, Twareat Health will not record, censor or edit the content of the information transmitted to and from any third party. By using the Service, you expressly acknowledge and agree that Twareat Health shall not be responsible for any damages, claims or other liability arising from or related to your transmission of information to and from Twareat Halth.

Subject to your compliance with these Terms, Twareat Health hereby grants you permission to use the service, provided that: (1) your use of the Service as permitted is solely for your personal use, and you are not permitted to resell or charge others for use of or access to the service, or in any other manner inconsistent with these Terms; (2) you will not duplicate, transfer, give access to, copy or distribute any part of the service in any medium without Twareat Health’ prior written authorization; (3) you will not attempt to reverse engineer, alter or modify any part of the service; and (4) you will otherwise comply with the terms and conditions of these Terms.

You must notify Twareat Health immediately of any breach of security or unauthorized use of your mobile phone or computer. Although Twareat Health will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of Twareat Health or others due to such unauthorized use.

The design of the Service along with Twareat Health created text, scripts, graphics, interactive features and the like, the trademarks, service marks and logos contained therein, are owned by or licensed to Twareat Health, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. The Service is provided to you as is for your information and personal use only. Twareat Health reserves all rights not expressly granted in and to the service. You agree to not engage in the use, copying, or distribution of any of the service other than expressly permitted herein, including any use, copying, or distribution of videos of third parties obtained through the Service for any commercial purposes.

You agree that your use of the service shall be at your sole risk. To the fullest extent permitted by law, Twareat Health, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the service and your use thereof. Twareat Health makes no warranties or representations about the accuracy or completeness of this service's content and assumes no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content, (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our service, (3) any unauthorized access to or use of our servers and/or any and all personal information and/or financial information held therein, (4) any interruption or cessation of transmission to or from our service, (iv) any bugs, viruses, trojan horses, or the like which may be transmitted to or through our service through the actions of any third party, and/or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content transmitted, or otherwise made available via the service. Twareat Health does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the service or other advertising, and Twareat Health will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services. As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

In no event shall Twareat Health, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (1) errors, mistakes, or inaccuracies of content, (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our service, (3) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information held therein, (4) any interruption or cessation of transmission to or from our servers, (5) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our service by any third party, (6) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content transmitted, or otherwise made available via the service, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages, and/or (7) the disclosure of information pursuant to these terms of service or data protection policy. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

The Service is controlled and offered by Twareat Health in selected locations. Those who access or use the Service do so at their own volition and are responsible for compliance with local law.

These Terms of Service shall be governed by the substantive laws of the Republic of Singapore, without respect to its conflict of laws principles. These Terms of Service, together with the Data Protection Policy at www.twareat.com and any other legal notices published by Twareat Health, including, but not limited to an end user license agreement, shall constitute the entire agreement between you and Twareat Health concerning the Service. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and Twareat Health’ failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. Twareat Health reserves the right to amend or modify these Terms at any time, and it is your responsibility to review these Terms for any changes. If you do not agree to the revised Terms, your only recourse is to discontinue the use of the Service. Your continued use of the Service following any amendment of these Terms will signify your assent to and acceptance of its revised terms. You and Twareat Health agree that any cause of action arising out of or related to the service must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

Breaches of these procedures may have serious legal and reputation repercussions and could cause material damage to Twareat Health. Consequently, breaches can potentially lead to disciplinary action that could include summary dismissal and to legal sanctions, including criminal penalties. All employees are expected to promptly and fully report any breaches of the Procedures. A report may be made to the employees’ supervisor or the Group General Counsel. Reports made in good faith by someone who has not breached these procedures will not reflect badly on that person or their career at TMC.
